Terms and Conditions of CrossFit YouAct

  1. In these terms and conditions, “CrossFit YouAct” refers to the owners, employees, independent contractors, and/or volunteers employed by CrossFit YouAct.
  2. The member, participant, and/or purchaser of any service or product from CrossFit YouAct will be addressed informally as “you” in these terms and conditions.
DELCARATION
  1. By purchasing a service or product from CrossFit YouAct, you agree to be bound by the terms and rules as outlined below.
  2. For minors (under the age of 16), permission from a parent or other legal representative is required.
DAMAGE AND LIABILITY
  1. CrossFit YouAct accepts no liability for damage, loss, and/or theft of your belongings.
  2. CrossFit YouAct accepts no liability for personal or bodily injury sustained by you, and any resulting damages.
  3. You acknowledge that the sports instruction, nutritional advice, or lifestyle guidance provided is undertaken at your own risk. As a result, you will be responsible for all costs associated with any accident, incident, or injury, in the broadest sense.
  4. You acknowledge that participating in certain sports carries risks, and any potential (subsequent) damage resulting from practicing any sport is at your own risk.
  5. You shall fully indemnify CrossFit YouAct from all third-party claims in the broadest sense of the word.
HEALTH DECLARATION
  1. CrossFit YouAct expects that you are in good enough health to participate in the training sessions. You are responsible for obtaining any necessary medical clearance to engage in sports activities at or outside of CrossFit YouAct. CrossFit YouAct does not perform any health checks and assumes good health when you attend a session. If in doubt, you must consult a recognised doctor or therapist before starting or during the agreement with CrossFit YouAct. During the agreement period, you are obligated to report any pain, discomfort, unusual fatigue, and/or changes in your physical condition before, during, and after training to CrossFit YouAct.
INJURIES AND ILLNESS

Personal Training/ Personal Nutrition Coaching

  1. If you become ill (stomach flu, fever, etc.) or experience an unforeseen event outside of your control within 24 hours before your appointment or training session, your appointment will be rescheduled. This is allowed only once per month, and your membership validity will not be extended.
  2. In cases of minor injuries (e.g., a sprained ankle, stiff neck, or strained wrist) or muscle soreness, appointments and training sessions will proceed as scheduled, though in an adjusted format. Your membership will continue as usual.
  3. In the case of severe injuries or serious illness, you must contact your trainer/coach. After providing a doctor’s note, a suitable solution will be found for your training sessions, or your membership will be paused for the duration of the injury or illness.

Group Training

  1. If you cancel too late or are a no-show for a group class due to illness or unforeseen circumstances, you will lose the credit, and the class cannot be rescheduled.
  2. If you wish to move your reservation to another time on the same day but miss the free cancellation window, you may contact the relevant trainer or administration to request a transfer. Only after receiving confirmation can you assume that your request has been received and that you are registered for a different class.
  3. In cases of minor injuries (e.g., a sprained ankle, stiff neck, or strained wrist) or muscle soreness, you are allowed to participate in a group class in an adjusted format. Your membership will continue as usual.
  4. For severe injuries or serious illness, contact your trainer/coach. After providing a doctor’s note, a suitable solution will be found for your training sessions, or your membership will be paused for the duration of the injury or illness.
RESULTS
  1. For all CrossFit YouAct services, there is an obligation to guide you as best as possible throughout the service by employing a qualified person. CrossFit YouAct is obliged to fulfill its commitments, but it does not guarantee that the intended result will be achieved. CrossFit YouAct cannot be held responsible if you do not achieve the desired outcome. Success depends on your effort as well.
OPENING HOURS
  1. CrossFit YouAct reserves the right to modify opening hours.
  2. On official or recognized holidays, CrossFit YouAct may close or adjust opening hours.
  3. For team-building activities or trainer training sessions, YouAct reserves the right to change opening hours.
  4. Check the website for the most up-to-date opening hours.
CLASS SCHEDULE
  1. CrossFit YouAct reserves the right to change the schedule for classes, personal training, target training, and goal reviews.
  2. On official or recognized holidays, CrossFit YouAct may close or adjust class times.
  3. CrossFit YouAct reserves the right to postpone, modify, and/or cancel planned services due to, in its judgment, insufficient participants, holidays, instructor illness, any form of force majeure, or other circumstances determined by CrossFit YouAct.
  4. In the event of a long-term absence of a CrossFit trainer from CrossFit YouAct, CrossFit YouAct will make every effort to ensure the normal continuation of the lessons as soon as possible.
FINANCIAL
  1. YouAct reserves the right to change the prices of services and products at any time.
  2. Price changes for ongoing memberships will be announced in writing at least six weeks in advance.
  3. When payments are made via SEPA direct debit, you must ensure that sufficient funds are available in the specified account for the debit to occur. If payment is not made within 14 calendar days you will be given a final opportunity to pay the outstanding amount.
  4. If payment is not made within four weeks, the debt and any remaining membership installments will be transferred to a collection agency.
PERSONAL DATA
  1. CrossFit YouAct respects your privacy and ensures that the personal information you provide is processed in accordance with applicable privacy legislation, such as the General Data Protection Regulation (GDPR). You can read more about this in the privacy statement of CrossFit YouAct at https://www.youact.nl/privacybeleid/.
  2. CrossFit YouAct processes your personal data for the following purposes: invoicing, debtor administration, complaint handling, and dispute resolution, for market research, and for commercial purposes such as sales activities related to CrossFit YouAct’s services.
  3. You have the right to access, correct, or object to the processing of your personal data, as well as the right to request the deletion of your data. CrossFit YouAct may charge costs for providing access, making corrections, and/or handling objections, up to the legal maximum. You can submit objections to the processing of your personal data, as well as requests for access, correction, objection, and/or deletion, to admin@youact.nl.
  4. Changes to your personal situation (e.g., address, bank, or contact details) must be updated by the customer directly via SportBit. Failure to provide timely updates may result in additional costs, for instance, due to payment arrears and/or lack of awareness of price increases.

Additional Terms for Group Training

A membership for CrossFit group training can consist of a monthly subscription and/or a punch card. In addition to a monthly subscription, you can purchase individual sessions. You are responsible for managing your own membership, which can be done via SportBit.

MEMBERSHIP

Subscriptions

  1. Cancellation: The membership is indefinite and continues until canceled. If you do not cancel in time, it will automatically be renewed for the same period. 
  2. Cancellation period: For the monthly subscription, there is a one full calendar month notice. Example: If you cancel your monthly subscription on January 15 via SportBit, your membership will end on March 1. 
  3. Downgrading & upgrading: A downgrade or upgrade of a monthly subscription is possible. You can upgrade or downgrade your membership at any time via SportBit. 
  4. Downgrade: A downgrade takes effect after one full calendar month. Example: If you downgrade your subscription on January 15, the downgrade will take effect on March 1. 
  5. Upgrade: An upgrade to your subscription can take effect immediately or at a future date of your choosing. 
  6. Pausing: A monthly subscription can only be paused by emailing admin@youact.nl. The minimum pause period is four weeks, and the maximum is 12 weeks. After the pause period, your membership will automatically be reactivated. The cancellation period described in Article 2 will then apply again. A pause period cannot be applied retroactively. 

Important! A portion of the pause period will still be charged. When reactivated, any overpaid amount will be adjusted on the next payment term. 

All reservations for group classes during the pause period will be automatically canceled. 

Punch Cards

  1. Validity: A 10-session punch card for group lessons is valid for six months from the date of purchase. 
  2. Cancellation, pausing, or extension: It is not possible to cancel, pause, or extend the validity of a punch card. 
  3. Non-transferable: Punch cards are strictly personal and cannot be transferred to others. 
BOOKING AND CANCELLATION OF GROUP TRAINING

The following conditions apply to both subscriptions and punch cards: 

  1. Booking group training: You can sign up for group classes up to 28 days in advance via SportBit. You can register up to one minute before the start of the class. 
  2. Canceling group training: For the first two morning classes (Mon-Sun), you can cancel free of charge up to 12 hours before the class starts. If you cancel within 12 hours, you will lose the session (credit). For other classes, you can cancel free of charge up to 4 hours before the start of the class. If you cancel within 4 hours, you will lose the session (credit). 
  3. Group training waitlist: If a class is full, you will be placed on a waitlist. If a spot becomes available up to four hours before the class (or 12 hours for the first two morning classes), the first person on the waitlist will be automatically added to the class and notified via SportBit. If a spot opens within four or twelve hours of the class, everyone on the waitlist will be notified. The first to respond gets the spot. 

Additional Terms for Personal Training

MEMBERSHIP

Personal training can be purchased in the form of a punch card or a single session. After a consultation with one of our trainers, we will activate the product for you. You cannot do this yourself via SportBit.

Punch Cards

  1. Validity: You choose the number of personal training sessions per week (1, 2, or 3), the session duration (30 or 60 minutes), and the number of weeks (4, 8, 12, 16, or 24 weeks). For example: 2 sessions per week of 30 minutes each x 8 weeks = 16 sessions. You can spread these 16 sessions over 8 weeks. Since it may not always be possible or advisable to complete all sessions within 8 weeks, we have extended the validity of all punch cards by 25%. So, an 8-week punch card is valid for 10 weeks. The validity period starts from the first session. 
  2. Booking: You can book your personal training via our bookings page and plan sessions in advance for the entire period. The schedule shows when a trainer is available. You will be assigned a head coach, and ideally, you will do most of your sessions with them. However, you can also schedule sessions with other coaches. You must book your session at least 24 hours in advance. 
  3. Rescheduling: You can reschedule your session up to 24 hours before it starts. You cancel and rebook via our bookings page. CrossFit YouAct cannot guarantee that there will be a suitable time slot available for you. If you wish to reschedule within 24 hours, you can contact admin@youact.nl, but please note that we cannot guarantee immediate response or availability. 
  4. Cancellation: We value commitment. If you are unable to attend a session, you can reschedule up to one week in advance. If you cancel within 24 hours of the session, it will count as a completed session and cannot be rescheduled. 
  5. Late arrivals: Personal training sessions start and end at the scheduled time. If a session starts late due to reasons beyond CrossFit YouAct’s control, this does not justify extending the session beyond its scheduled time. 
  6. Non-transferable: The sessions are personal and cannot be transferred to others. 

Single Session

  1. Validity: A single session must be scheduled within two weeks of purchase. 
  2. Booking: You can book your personal training session via our bookings page, up to two weeks in advance. You must book your session at least 24 hours before it starts. 
  3. Rescheduling: You can reschedule your session up to 24 hours before it starts. You cancel and rebook via our bookings page. If you want to reschedule within the same day, contact the trainer directly. This is not guaranteed as the trainer may not respond in time or there may be no available slots. 
  4. Cancellation: We value commitment. If you are unable to attend a session, you can reschedule up to 24 hours in advance. If you cancel within 24 hours, it will count as a completed session. 
  5. Late arrivals: Personal training sessions start and end at the scheduled time. If the session starts late due to reasons beyond CrossFit YouAct’s control, this does not justify extending the session. 
  6. Non-transferable: Sessions are personal and cannot be transferred to others. 

Trainer/Coach

  1. The training program is the focus. You will be assigned a head coach, but you may also be guided by other trainers from CrossFit YouAct. 
  2. If the trainer/coach is absent, you can expect a suitable replacement. If no replacement is available, payments and sessions will be suspended until a trainer/coach is available to continue the training.

Additional Terms for Personal Program

When you indicate that you would like to work with a specific goal in mind, with a personalized training program outside of group classes, you can request a non-binding consultation with one of our trainers. Together with the trainer, you can discuss whether a personal program suits you. A personal program consists of a targeted training plan, personal training sessions, online coaching, and independent training at YouAct. The frequency and duration of the various sessions will be determined in consultation with the trainer.

MEMBERSHIP

A personal program consists of two punch cards, one for personal training and one for independent (target) training. After a conversation with one of our trainers, we will activate the products for you. You cannot do this yourself via Sportbit.

  1. Validity: You will determine the start date, duration, and frequency of your program in advance. For example, you may agree to start a 12-week program. Your punch cards are valid for 25% longer than the agreed period, meaning in this example the total validity is 15 weeks. After that, you will still have access to the program, but any unused credits for personal or independent training will expire. Online coaching will also stop. 
  2. Booking sessions: You are responsible for scheduling your personal and target training sessions. Personal Training via our bookings page and Target Training via SportBit. You can sign up for the entire period in advance.
  3. Extensions: You can extend the program for an additional fee. Together with your coach, you can choose from different punch cards and/or individual sessions.
  4. Pausing the program: You can pause your program once. The minimum pause duration is 2 weeks, after which the program will automatically resume. Please note that pausing does not automatically cancel your scheduled sessions. Be sure to cancel any personal or target training sessions during the pause period.   5. Cancellation: You can stop the program at any time, but we do not refund payments for missed sessions.
THE TRAINING PROGRAM
  1. In the initial consultation, the trainer will gather as much information as possible to create a customized training plan. 
  2. Before creating or personalizing the program, the trainer will conduct a baseline assessment with you during a personal training session. After that, the trainer will need up to 5 working days to process the results and send the program to you. 
  3. The training program will be assigned by a CrossFit YouAct trainer. The trainer may create a completely new program or use existing ones developed by CrossFit YouAct or other parties. If the trainer uses an existing program, it will be adjusted to suit your level and needs. 
  4. You can provide feedback on the program once, prior to the first session. The trainer will consider your feedback and, if necessary, make adjustments. The trainer will take a maximum of 30 minutes for this. 
  5. The training program will be shared with you digitally via Google Drive. 
  6. The program will include sufficient instructions and videos for you to complete the training sessions independently, in combination with personal training sessions. 
  7. As an athlete, you are responsible for tracking your training results.
PERSONAL TRAINING
  1. A personal program always includes personal training sessions for optimal guidance. The frequency and duration of these sessions will be determined with the trainer. Guidance during these sessions may include:
    • Reviewing the previous training period
    • Discussing the upcoming training period
    • Providing technical tips, possibly with video analysis
    • Making adjustments to the training program
    • Testing and evaluating your current level

Personal training is part of a personal program and is purchased through a punch card. After a conversation with one of our trainers, we will activate the product for you, which cannot be done through Sportbit. The punch card is subject to the additional terms of personal training.

ONLINE COACHING
  1. Once the program has started, you can track your training data in the Google Drive document. You can also leave comments about yourself and your training. If you do so in the document, your trainer will receive an email notification. The trainer will respond within 2 working days if necessary. 
  2. The trainer may contact you via email, WhatsApp, or phone if you haven’t trained for a while, haven’t logged data in Google Drive, or for other reasons. 
  3. If either you or the trainer feel that extended (online) coaching is needed (30 minutes or more), this can be scheduled as an (additional) personal training session, for which personal training rates will apply.
INDEPENDENT TRAINING
  1. You will receive credits to schedule your training sessions. These credits can only be used for independent training and cannot be transferred to others. 
  2. You are responsible for scheduling your training sessions via a specific schedule in SportBit. 
  3. Ensure you plan enough time for your sessions. If your training takes longer than the reserved time, inform your trainer so they can adjust your program. If space is available after your reservation, you may finish your training beyond the scheduled time without any extra charges. 
  4. Take care of the equipment and clean up after your training. If something accidentally breaks, report it immediately. There will be no charge to you, and we will arrange for it to be repaired.
TRAINER/COACH
  1. The training program is central to the process. You will be paired with a head coach, but you may receive guidance from various trainers at CrossFit YouAct. 
  2. If your trainer/coach is unavailable, a suitable replacement will be arranged. If no replacement is available, payments and sessions will be paused until a trainer/coach becomes available.

Additional Terms for Nutrition Coaching

MEMBERSHIP

If you’re interested in nutrition coaching, we first arrange a free, no-obligation consultation. For new clients, this can be scheduled through our bookings page or during a walk-in session. CrossFit YouAct members can also book a goal review for this. You can choose from three onboarding packages for nutrition coaching, after which we work with individual sessions. If you’re looking for a low-barrier way to stay accountable, you can subscribe to our app to track your eating habits and receive online feedback from our nutrition coach. Several times a year, we offer nutrition challenges in group package form, which do not require an intake consultation.

Onboarding Packages

  1. Validity:
    • Set & Check: Two 60-minute sessions (valid for 8 weeks). 
    • 3-Month Package: 2 x 60-minute sessions and 4 x 30-minute sessions (valid for 16 weeks). 
    • 6-Month Package: 2 x 60-minute sessions and 8 x 30-minute sessions (valid for 32 weeks). 
  2. Registration: We activate the selected package for you. You can register for a personal nutrition session through our bookings page. All sessions from your package can be scheduled in advance. Registration for a session is possible up to 24 hours before the start.
  3. Rescheduling: You can freely reschedule your session up to 24 hours before it starts through the bookings page. If you need to reschedule within 24 hours of your session on the same day, message the coach, and they will attempt to reschedule it. However, success is not guaranteed, as the coach may not be able to respond in time or there may be no available slots.
  4. Cancellation: Commitment is important to us. If you cannot attend a session, you may reschedule it up to 24 hours in advance. If you cancel within 24 hours, the session will be considered completed and cannot be made up.
  5. Pause: In principle, your nutrition journey can continue, even remotely, during busy periods, illness, or celebrations—moments when your eating habits may be challenged. Together with your coach, you can explore how to manage these situations. Only if it’s irresponsible to focus on your diet (e.g., in the case of an eating disorder) can the program be paused with a doctor’s note.
  6. Termination: Your coach reserves the right to terminate the program early, in which case any missed sessions will be financially compensated.
  7. App: During the 3- and 6-month onboarding packages, we use an app for tracking your nutrition. Further terms for using the app are listed below.

Individual Sessions

After completing an onboarding package or nutrition challenge, you can book individual sessions. These can also be used as an addition to an ongoing onboarding, challenge, or subscription if you need more intensive guidance. Sessions can be purchased via SportBit.

  1. Validity: An individual session must be scheduled within two weeks of purchase.
  2. Registration: You can register for a coaching session through our bookings page, scheduling up to two weeks in advance. Registration is open until 24 hours before the session.
  3. Rescheduling: You can freely reschedule your session up to 24 hours before it starts via the same bookings page. If you need to reschedule within 24 hours of your session on the same day, message the coach, and they will attempt to reschedule it. However, success is not guaranteed.
  4. Cancellation: As with onboarding sessions, commitment is essential. If you cancel less than 24 hours before your session, it will be considered completed.
  5. Late Arrivals: Sessions start and end at the scheduled time. If your session starts late through no fault of CrossFit YouAct, the session duration will not be extended.
  6. Non-Transferable: Sessions are personal and cannot be transferred to others.

Nutrition Challenge

A nutrition challenge consists of group sessions scheduled at fixed times, with a start and end date.

  1. Absence: If you miss a session for any reason, no financial compensation will be provided. You can make up the missed session with a one-on-one session at the standard individual coaching rates.
  2. Non-Transferable: Like other sessions, nutrition challenge sessions are personal and cannot be transferred.
  3. Late Arrivals: Sessions start and end at the scheduled time. If the session starts late through no fault of CrossFit YouAct, the duration will not be extended.
  4. App: During the challenge, we use an app for tracking your nutrition. Additional terms for using the app are provided below.

Nutrition Tracking App

To track your nutrition and receive online feedback from one of our nutrition experts, you can subscribe to our app on a monthly basis.

  1. We expect you to fill in the app honestly and completely.
  2. You can ask brief questions via the app.
  3. A nutrition expert will review your eating habits in the app and provide feedback every two weeks. Short questions will also be answered at that time. If you have additional questions after receiving feedback, they will be answered during the next two-week review. If you need quicker assistance, you can book a one-on-one session at standard rates.
  4. Cancellation: The app subscription is for an indefinite period with a minimum commitment of three months and will automatically renew unless canceled. You can cancel by emailing nutrition@youact.nl.
  5. Notice Period: The app subscription has a notice period of one full calendar month. For example, if you cancel on January 15, your subscription will end on March 1.
